Sexual Assault Reported at SMU, Ctd.

John David Mahaffey, 19, was arrested by SMU police and charged with the sexual assault of another male student on campus Tuesday night, according to the Dallas County District Attorney’s office.

According to an SMU campus alert, at 3 a.m. Sunday a victim was assaulted twice at two different locations on campus. The first took place at the Sigma Phi Epsilon fraternity, with the second at the Airline Parking Garage near the north end of the campus.

SMU spokesman Kent Best said SMU Police arrested a student for an alleged sexual assault that occurred Sept. 23 on the SMU campus. He said SMU police will present the findings of its investigation to the Dallas County District Attorney’s Office. The student is temporarily banned from campus pending further investigation.

SMU’s The Daily Campus first reported the story late Thursday night. According to the article, Mahaffey is a fourth-generation SMU student whose great-great grandfather was a member of the founding committee for the university and an interim professor when the university opened.

Mahaffey was booked into the Dallas County Jail Tuesday and posted a $25,000 bond Wednesday, according to Dallas County media relations.

This was the fourth sexual assault reported on campus this year.

    “Alleged” get’s your picture splashed over the place?

    If he is guilty, lock him up forever for all I care, but what if he is found not guilty? How do you undo that?

    @XT: Right on all counts. Police, prosecutors and butt-covering university administrators will go to almost any lengths to get the results they want.

    All that said, things are not looking good for this guy:

    “SMU police say they have a phone recording of sexual assault suspect John David Mahaffey, 19, telling a student who gave him oral sex to say their encounter was consensual ‘or lawyers, parents, and the school will be involved,’ according to an arrest warrant affidavit filed in the case.

    “The next day, the student met with SMU police and agreed to record a phone call with Mahaffey. During the phone call, he told Mahaffey ‘you know I did not want to do that?’ According to the affidavit, Mahaffey replied, ‘I know you didn’t, but we have to say it was consensual or lawyers, parents, and the school will be involved.'”

    Yowza.

    It IS kind of disturbing that because of the internet, if you are ever accused of anything, it will follow you forever. In the “old days” someone would have to do all kinds of physical searching to track down something you did 20 years ago. But from now until he dies, when someone Googles his name this will come up, no matter what the final resolution of the case is.

    More than alleged. He’s been arrested. That’s enough for publishing a mug shot. Still, innocent till proven guilty.

    Perhaps it was illegal hazing? From NBCDFW.com:

    An affidavit of probable cause filed by an SMU police investigator provides graphic details.

    Mahaffey forced the other student to perform a sexual act on him, the officer said.

    “Victim stated ‘NO’ and ‘STOP’ several times but felt intimidated and physically forced into compliance,” the affidavit said.

    The following day, the student went to police and agreed to make a recorded phone call to Mahaffey, police said.

    “During the phone call, the victim told the defendant, ‘You know I didn’t want to do that?’ The defendant replied, ‘I know you didn’t, but we have to say it was consensual or lawyers, parents, and the school will be involved.’”
